Obiettivi Formativi
L'obiettivo generale del corso è quello di far familiarizzare gli studenti con il diritto privato italiano nella cornice europea. Il corso è finalizzato all'acquisizione di competenze nell'interpretazione e nell'uso delle fonti al fine di risolvere questioni giuridiche. Il corso combina un programma pratico radicato in una comprensione teorica. Pertanto gli studenti miglioreranno le capacità analitiche nella parte teorica e le capacità di problem solving nella soluzione delle questioni giuridiche. Saranno in grado di motivare le loro risposte utilizzando il linguaggio tecnico giuridico.
Learning Objectives
The general goal of the course is to familiarize the students with the Italian private law within the European framework. The course is aimed at acquiring skills in interpreting and using sources in order to solve legal cases.
The course combines a practical programme rooted in a theoretical understanding.Therefore the students will improve analytical skills in the theoretical part and problem-solving skills in the solution of legal cases. They will be able to justify their answers using the technical legal language.

Il corso intende fornire ai partecipanti alcune categorie e nozioni fondamentali del diritto privato italiano entro il quadro normativo dell'Unione europea.
Gli studenti acquisiranno la conoscenza e la comprensione di alcune categorie giuridiche fondamentali del diritto dei contratti e delle obbligazioni e svilupperanno nuove competenze non solo nell'interpretare autonomamente il diritto privato italiano vigente, ricercando la ratio sottesa alle disposizioni, ma anche nell'individuare connessioni tra gli istituti compresi nel programma e nell'attingere alle fonti giuridiche per la soluzione di casi pratici.
Gli studenti, quindi, miglioreranno le capacità analitiche nella parte teorica del corso e svilupperanno capacità di problem-solving nella soluzione di casi giuridici.
Acquisiranno familiarità con le nozioni fondamentali del diritto delle obbligazioni e del contratto; matureranno la capacità di affrontare criticamente questioni giuridiche alla luce delle disposizioni del codice civile italiano; acquisiranno capacità di argomentazione giuridica; impareranno a proporre e giustificare le loro conclusioni, utilizzando correttamente il linguaggio tecnico giuridico.

Learning Objectives
The course is intended to provide the participants with basic categories and notions of Italian Private Law within the context of the European Union legal framework.
The students will acquire knowledge and understanding of some fundamental legal categories of contract and obligations law and will develop new skills not only in autonomously interpreting existing Italian Private Law, looking at the underlying rationale behind the provisions but also in making connections between the various topics covered and in referring to the legal sources in order to solve legal cases.
The students will therefore both improve analytical skills in the theoretical part of the course and develop problem-solving skills in the solution of legal cases.
They will become familiar with the fundamental notions of obligations and contract law; acquire the ability to critically adress legal issues in the light of the provisions of the Italian civil code; they will learn how to adequately manage legal reasoning; propose and justify their findings, properly using the technical legal language.

Modalità di svolgimento
Il corso si articola in una serie di lezioni frontali, esercitazioni e analisi di casi.
Teaching methods
The course consists in a series of lectures, exercises and case analysis.
Regolamento Esame
Nell'esame finale si valuta l'assimilazione da parte dello studente dei fondamenti del diritto privato italiano con riferimento agli argomenti del programma sopra indicato.
Si valuta la capacità dello studente d'interpretare autonomamente le disposizioni normative, individuandone la ratio; di stabilire collegamenti sistematici e argomentare su questioni giuridiche con rigore logico e correttezza di linguaggio. Lo studente deve dimostrare di aver
aver assimilato i contenuti teorici del corso; di esser capace di analizzare questioni giuriche argomentando in modo coerente e con impiego di termini tecnici appropriati, anche nella soluzione di casi pratici.
Il voto finale è espresso in trentesimi e rispecchia la profondità e l'ampiezza della preparazione sui temi fondamentali del diritto privato sintetizzati nel programma d'esame; le abilità espositive e la capacità di analisi critica sviluppate al termine del corso. L'esame è superato col voto pari o superiore a 18/30. La prova finale è superata con 30 e lode quando lo studente dimostra di aver acquisito una conoscenza eccellente di tutti gli argomenti trattati durante il corso e appare particolarmente meritevole, dimostrando unitamente a una conoscenza particolarmente approfondita e ampia della materia, la capacità di analizzare criticamente le questioni giuridiche.

Exam Rules
The final examination will assess the student's acquisition of the fundamental notions of Italian Private Law in relation to the topics listed in the detailed teaching program; the student's ability to independently interpret normative provisions, identifying their underlying rationale and to argue on legal issues properly managing the technical legal language.
The student must demonstrate the comprehension of the theoretical content of the course; to be able to make connections between the various topics covered and to autonomously deal with private law issues, arguing coherently and using correct legal terms also in the solution of practical cases.
The final grade is expressed in thirties and reflects the depth and breadth of the preparation on the fundamental topics of private law summarized in the exam program; the communication skills and the ability to critical analysis developed at the end of the course. The exam is passed with a grade of 18/30 or higher. The final exam is passed with 30 cum laude when the student proves to have acquired an excellent knowledge of all the topics covered during the course and appears particularly deserving, showing together with a particulary thorough and extensive knowledge of the subject, the ability to critically analyse legal issues.
