Learning Objectives

The course is intended to provide the participants with basic categories and notions of Italian Private Law within the context of the European Union legal framework.

The students will acquire knowledge and understanding of some fundamental legal categories of contract and obligations law and will develop new skills not only in autonomously interpreting existing Italian Private Law, looking at the underlying rationale behind the provisions but also in making connections between the various topics covered and in referring to the legal sources in order to solve legal cases.

The students will therefore both improve analytical skills in the theoretical part of the course and develop problem-solving skills in the solution of legal cases.
They will become familiar with the fundamental notions of obligations and contract law; acquire the ability to critically adress legal issues in the light of the provisions of the Italian civil code; they will learn how to adequately manage legal reasoning; propose and justify their findings, properly using the technical legal language.

The course will be focused on natural persons and legal entities, obligations law, contracts law and tort law. Topics include:

Teaching methods

The course consists in a series of lectures, exercises and case analysis.

Exam Rules

The final examination will assess the student's acquisition of the fundamental notions of Italian Private Law in relation to the topics listed in the detailed teaching program; the student's ability to independently interpret normative provisions, identifying their underlying rationale and to argue on legal issues properly managing the technical legal language.
The student must demonstrate the comprehension of the theoretical content of the course; to be able to make connections between the various topics covered and to autonomously deal with private law issues, arguing coherently and using correct legal terms also in the solution of practical cases.
The final grade is expressed in thirties and reflects the depth and breadth of the preparation on the fundamental topics of private law summarized in the exam program; the communication skills and the ability to critical analysis developed at the end of the course. The exam is passed with a grade of 18/30 or higher. The final exam is passed with 30 cum laude when the student proves to have acquired an excellent knowledge of all the topics covered during the course and appears particularly deserving, showing together with a particulary thorough and extensive knowledge of the subject, the ability to critically analyse legal issues.
