Il voto finale per l'Esame di Tradizioni Giuridiche e Diritto Comparato sarà la media dei voti ottenuti nei tre Moduli. Questo voto sarà determinato nella data dell'esame finale. Per le date dell'Esame Finale, si prega di consultare il sito del programma nella pagina degli Esami.
Gli studenti che superano uno o due dei tre moduli solo nelle prime 2 date della sessione invernale possono completare l'esame nella sessione autunnale (settembre).
I voti ottenuti rimarranno validi o potranno essere respinti. Se respinti, l'esame del modulo dovrà essere ripetuto integralmente. I voti ottenuti nei moduli non sono validi oltre la Sessione Autunnale (settembre).
Exam Rules
The final grade for the Exam of Legal Traditions and Comparative Law will be the average of the grades obtained in the three Modules. This grade will be determined on the date of the final exam. For the dates of the Final Exam, please refer to the program website on the Exams page.
Students who pass only one or two out of the three modules within the first 2 dates of the Winter session can complete the exam in the Fall (September) session.
Grades obtained will remain valid or can be rejected. If rejected, the module exam will need to be retaken in full. The grades obtained in the modules are not valid beyond the Fall (September) Session.

Tema 1: Radici teoriche del costituzionalismo moderno. Costituzionalismo antico e moderno.
Tema 2: Costituzionalismo inglese: il rapporto con il sistema giuridico del common law, la richiesta di separazione dei poteri e diritti fondamentali.
Tema 3: L'emergere del costituzionalismo nell'era delle rivoluzioni: Il costituzionalismo delle rivoluzioni francese e americana, modelli comuni e percorsi differenti.
Tema 4: La Costituzione americana: rigidità costituzionale, il controllo giudiziario della legislazione, federalismo. Il processo di democratizzazione.
Tema 5: Costituzione e Stato nel XIX secolo: costituzionalismo liberale in Europa.
Tema 6: Il costituzionalismo contemporaneo americano: Il Congresso e la Presidenza, trasformazioni nell'interpretazione del federalismo e dei diritti costituzionali (il ruolo della Corte Suprema).
Tema 7: Costituzioni europee nel secondo dopoguerra: diritti fondamentali, forme di governo, regionalismo, fonti del diritto.
Tema 8: Diffusione globale del costituzionalismo occidentale.
Tema 9: Stato costituzionale aperto: lo sviluppo dell'ordine giuridico dell'Unione Europea e le sue istituzioni.

claim for separation of powers and fundamental rights.
Topic 3 The Rise of Constitutionalism in the Age of Revolutions: French and American
Revolutions constitutionalism, common patterns and different paths
Topic 4 American Constitution: constitutional rigidity, the judicial review of the legislation,
federalism. The process of democratization.
Topic 5 Constitution and State in 19th Century: liberal constitutionalism in Europe.
Topic 6 American contemporary constitutionalism: Congress and the Presidency,
transformations in the interpretation of federalism and constitutional rights (the role
of the Supreme Court).
Topic 7 European Constitutions in Post-Second World War: fundamental rights, forms of
government, regionalism, sources of law.
Topic 8 Worldwide expansion of Western Constitutionalism.

First Module: A written exam will be held during the mid-term week. Students who do not pass the exam will have the opportunity to retake it only once in the Winter session (February) and in the Fall session.

Course Description
The course provides an introduction to the study of law in the global scenario. Through a historical and comparative approach, the course deals with the (i) legal systems of the World and the system of sources of law, (ii) the private and public law fundamental institutions in the World, (iii) the Roman foundation of legal institutions, (iv) the fundamental concepts of law and their historical development, (v) constitutionalism in the framework of the Nation State and the constitutional framework of contemporary democratic political systems.
The course is divided into three modules:

- 2nd Module, Harmonization of law and legal history, Prof. Riccardo Cardilli, 4 CFU

The course will provide an introduction to the principles, categories, institutions and vocabulary of law. The comparative approach is aimed at providing awareness of the diversity existing in the legal traditions of the World, as well as of the relationships existing between legal systems, history and culture.

Course Description
